Terms of Service

The rules governing DU2BAO2 accounts, listings, transactions, Protected Checkout and marketplace use.

1. Acceptance and incorporated policies

By accessing or using DU2BAO2, you agree to these Terms and policies expressly incorporated into them, including the Privacy Notice, Buyer Protection & Refund Policy, Authenticity & Counterfeit Policy and Prohibited Items Policy. If you do not agree, do not use the Services. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded under Malaysian law.

2. Platform operator

3. Marketplace role

DU2BAO2 is an online marketplace that enables users to advertise, discover, buy and sell goods. Unless DU2BAO2 expressly identifies itself as seller for a transaction, DU2BAO2 does not own the user-listed item, does not take title to it and is not its manufacturer. The contract for a user-listed item is normally between buyer and seller.

DU2BAO2 may nevertheless provide listing review, identity verification, fraud prevention, payment facilitation, delivery integrations, authentication services, Buyer Protection and dispute administration.

4. Eligibility and accounts

  • Users entering transactions or receiving seller payouts must be at least 18 and capable of entering a binding agreement.
  • Provide accurate and current account information.
  • Protect login credentials and notify DU2BAO2 of suspected unauthorised access.
  • Do not impersonate another person, use false identity information, manipulate ratings or create accounts to evade restrictions.

5. Seller verification

DU2BAO2 may require a seller to provide legal name, address, telephone number, email, NRIC/passport information where required, business details, payout information and other supporting documents. Certain information may be retained privately for compliance and fraud prevention while information required by law may be displayed publicly.

6. Required seller and listing disclosures

Sellers must provide prescribed marketplace information required by Malaysian electronic-trade law, including seller identity/contact information, trading address, product description and main characteristics, full price and applicable charges, payment methods, sale terms, estimated delivery time and applicable safety or health certification. Information required in Bahasa Malaysia must be supplied in Bahasa Malaysia; additional languages may also be shown.

7. Seller warranties

  • The seller owns the item or is legally authorised to sell it.
  • The item is not stolen, counterfeit, unlawful or prohibited.
  • The listing and actual-item photographs are materially accurate and not misleading.
  • Material defects, repairs, alterations and missing components are disclosed.
  • Serial numbers, receipts and authenticity documents supplied are genuine to the seller’s knowledge.
  • The listing does not knowingly infringe third-party intellectual-property rights.

8. Used goods

Pre-owned goods may show ordinary wear consistent with age and disclosed condition. Ordinary scratches, patina, ageing or other visible/disclosed wear do not automatically make an item not as described. Sellers must still disclose material defects that would reasonably affect a buyer’s decision.

9. Counterfeit goods

Counterfeit goods are strictly prohibited. Ordinary listing approval is not an authentication certificate. Where DU2BAO2 reasonably suspects counterfeit activity, it may remove the listing, request evidence, restrict the account, delay an eligible Platform-facilitated payout where permitted, preserve records and cooperate with relevant authorities or rights holders.

If a counterfeit item is confirmed in an eligible DU2BAO2 Protection transaction, DU2BAO2 may refund the buyer under the Buyer Protection Policy. The seller remains financially responsible for amounts properly refunded because of the seller’s counterfeit item, including reasonable related costs where permitted by law and applicable payment arrangements.

10. Prohibited items

Users must comply with the DU2BAO2 Prohibited Items Policy. Prohibited goods include counterfeit or stolen goods, unlawful drugs, weapons, tobacco/vape products, unlawful medicines, pirated goods, unsafe products, infringing goods and any item whose possession, advertisement, sale or delivery would violate Malaysian law or DU2BAO2 policy.

11. Listing review

DU2BAO2 may approve, reject, hide, recategorise or remove listings and may request extra photographs, ownership proof or authentication evidence. Publication does not guarantee authenticity, ownership, safety, condition or seller reliability.

12. Direct transactions and Protected Checkout

Direct transactions

Users may arrange meetup, COD, DuitNow, direct bank transfer or another direct method. If DU2BAO2 does not receive or control the payment, DU2BAO2 normally cannot reverse, freeze or recover it. Users may still report fraud, counterfeit goods or misconduct.

DU2BAO2 Protection / Protected Checkout

Where a listing or checkout page expressly displays DU2BAO2 Protection, the transaction may be processed through an integrated third-party payment provider and become eligible for the Buyer Protection process. Protection does not apply merely because users met through DU2BAO2.

13. Payment processing and payout

DU2BAO2 may use independent payment providers. DU2BAO2 must not be described as operating a regulated escrow service unless the implemented provider arrangement legally and contractually supports that description.

For an eligible protected transaction, seller payout will normally become eligible after the buyer confirms receipt and acceptance or 48 hours after tracked delivery is recorded as delivered with no eligible dispute, subject to fraud, chargeback, counterfeit, payment-provider, legal or regulatory holds.

14. DU2BAO2 Protection

The Buyer Protection & Refund Policy governs eligibility, the 48-hour standard Protection Window, evidence, returns and refunds. The 48-hour window governs the Platform payout process and does not extinguish statutory rights that cannot lawfully be excluded.

15. Seller responsibility for protected refunds

If DU2BAO2 or its payment provider refunds a buyer because the seller supplied a counterfeit item, wrong item, materially misdescribed item or other item for which the seller is responsible, the seller remains liable for the refunded amount and applicable reasonable return, authentication, reversal or dispute costs to the extent permitted by law.

Where legally and technically permitted, DU2BAO2 may deduct amounts properly due from pending payouts, seller balances or future amounts otherwise payable to that seller, or pursue lawful recovery.

16. Disputes and evidence

DU2BAO2 may request photographs, video, packing evidence, serial numbers, receipts, authentication reports, courier records, messages, service-centre reports and other relevant evidence. DU2BAO2’s determination governs how DU2BAO2 Protection and the related Platform payment are administered; it is not a court or tribunal judgment.

17. Returns and refund abuse

Approved returns must follow the Buyer Protection Policy. Buyers must return the same item and must not swap items, parts, batteries, stones, accessories or serial-number components. Deliberate return fraud may result in claim rejection, account termination, evidence preservation and referral to competent authorities.

18. Delivery

Sellers must pack appropriately, provide accurate parcel information and dispatch within the represented period. Buyers must provide an accurate delivery address. Independent couriers may have their own liability, declared-value and insurance limits.

19. Communications and fraud prevention

Users must not send phishing links, fake payment pages, malware, threats or requests for passwords/one-time codes. DU2BAO2 may use automated and manual safety controls and may restrict transactions, listings, accounts or eligible payouts while investigating suspicious activity.

20. User content and intellectual property

Users retain ownership of content they create but grant DU2BAO2 a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, resize, format and use that content to operate, secure, improve and promote the marketplace. Users must have the rights needed to upload their content.

21. Fees, tax and e-Invoicing

DU2BAO2 may charge transaction, protection, authentication, promotion or other disclosed fees. Users remain responsible for their own tax obligations. DU2BAO2 may collect information reasonably necessary for accounting, statutory records and Malaysian e-Invoicing requirements where applicable.

22. Suspension and termination

DU2BAO2 may proportionately restrict, suspend or terminate accounts, remove listings or hold eligible Platform payouts where reasonably necessary for fraud, counterfeit goods, prohibited activity, payment abuse, intellectual-property complaints, serious policy breaches, security or legal requirements. Serious matters may justify immediate action.

23. Platform availability and third-party services

The Platform is provided on an “as available” basis. DU2BAO2 may rely on independent payment providers, couriers, authentication providers, login providers, cloud infrastructure and other services, which may have their own terms. Nothing here limits obligations that cannot lawfully be excluded.

24. Limitation of liability

To the maximum extent permitted by Malaysian law, DU2BAO2 is not responsible for indirect or consequential loss arising solely from another user’s conduct, an off-Platform payment, user-generated misdescription, undisclosed seller defects, independent courier failure or independent third-party service failure outside DU2BAO2’s reasonable control.

Where liability for a paid DU2BAO2 service may lawfully be limited, aggregate liability arising directly from that service will not exceed the Platform fees paid to DU2BAO2 for the transaction giving rise to the claim. This does not apply where such limitation would be unlawful.

25. Indemnity

To the extent permitted by law, a user must indemnify DU2BAO2 for reasonable third-party claims and losses arising from that user’s unlawful conduct, counterfeit or stolen goods, fraud, intellectual-property infringement, material breach of these Terms or violation of another person’s legal rights. This does not require indemnification for loss caused solely by DU2BAO2’s unlawful conduct.

26. Records and authorities

DU2BAO2 may retain seller, listing, advertising, complaint and transaction records for at least the period required by Malaysian law, including three years where applicable, and longer where reasonably necessary for disputes, fraud, tax, litigation or lawful requests. DU2BAO2 may preserve or disclose relevant records to competent authorities where required or permitted by law.

27. Complaints

Marketplace complaints may be submitted through DU2BAO2’s report/support channels. Fraud, counterfeit, stolen-property and account-security concerns should be reported promptly. An eligible consumer may also have access to statutory channels including the Tribunal for Consumer Claims Malaysia where applicable.

28. Changes, severability and no waiver

DU2BAO2 may update these Terms as services and laws change. Material changes should be communicated where reasonably appropriate. If a provision is invalid or unenforceable, the remaining provisions continue. Failure to immediately enforce a provision is not a permanent waiver.

29. Governing law

These Terms are governed by the laws of Malaysia. Malaysian courts have jurisdiction subject to any applicable statutory tribunal or dispute-resolution mechanism. Nothing prevents an eligible user from exercising a statutory right before TTPM or another competent authority.

All trademarks and brand names are the property of their respective owners.

Ordinary listing approval is not an authenticity guarantee. Only an item expressly marked Authenticated has completed the authentication process stated for that listing. DU2BAO2 Protection applies only to eligible transactions where Protected Checkout is expressly displayed and used.
